Canyon Therapy ("we," "us," or "our") is committed to protecting your personal information and your right to privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website (the "Site") or use our painting services.
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
About This Notice
Canyon Therapy is required by law to maintain the privacy of your protected health information (PHI), to provide you with this Notice of our legal duties and privacy practices, and to follow the terms of this Notice as currently in effect.
Protected health information is information that identifies you — including demographic information such as your name, address, and date of birth — and relates to your past, present, or future physical or mental health condition, the healthcare services you receive, or payment for those services.
We are required to notify you if a breach occurs that may have compromised the privacy or security of your information.
When you first receive care at Canyon Therapy, we will ask you to acknowledge in writing that you have received this Notice. If we are unable to obtain your acknowledgment, we will document our good-faith effort to do so.
How We May Use and Disclose Your Health Information
Canyon Therapy may use and disclose your protected health information for the following purposes without your written authorization:
For Treatment We may use your health information to provide, coordinate, and manage your care. This includes sharing information with other healthcare professionals involved in your treatment. For example, if your therapist determines a consultation with a specialist would benefit your care, relevant health information may be shared with that provider.
For Payment We may use and disclose your health information to obtain payment for services provided to you. For example, we may share information with your health insurance company to obtain approval for treatment or to process claims for services you have received.
For Healthcare Operations We may use and disclose your health information for activities that support the operation of our practice and ensure quality care. These activities include quality assessments, staff training, licensing and credentialing, business planning, and audits.
For Appointment Reminders and Health-Related Communications We may use your health information to contact you with appointment reminders, information about treatment alternatives, or other health-related benefits and services that may be of interest to you.
Personal Representatives We will treat a personal representative — such as a parent or legal guardian of a minor child, or a person with healthcare power of attorney — the same as we would treat the patient with respect to uses and disclosures of that patient's protected health information, to the extent required by law.
Other Uses and Disclosures That Do Not Require Your Authorization
Canyon Therapy may also use or disclose your health information without your authorization in the following circumstances, as permitted or required by law:
As Required by Law — When federal, state, or local law requires disclosure.
Public Health Activities — To report disease, injury, vital events, and to conduct public health surveillance, investigations, and interventions as authorized by law.
Victims of Abuse, Neglect, or Domestic Violence — To notify government authorities if we reasonably believe you are a victim of abuse, neglect, or domestic violence, as authorized or required by law.
Health Oversight Activities — To a health oversight agency for activities authorized by law, including audits, investigations, inspections, and licensure actions.
Judicial and Administrative Proceedings — In response to a court order or, in certain conditions, in response to a subpoena or other lawful process.
Law Enforcement Purposes — For law enforcement purposes as required by law or in response to a valid court order, warrant, subpoena, or similar process.
Coroners, Medical Examiners, and Funeral Directors — To a coroner, medical examiner, or funeral director as authorized by law.
Organ and Tissue Donation — To organizations that facilitate organ, eye, or tissue procurement, banking, or transplantation, if you are an organ donor.
Research — For research purposes under specific conditions approved by an institutional review board or privacy board.
Serious Threat to Health or Safety — To prevent or lessen a serious and imminent threat to the health or safety of a person or the public, consistent with applicable law.
Workers' Compensation — As authorized by and necessary to comply with workers' compensation laws.
Military and Veterans — If you are a member of the armed forces, as required by military command authorities.
Communication with Family and Others Involved in Your Care — Using our best judgment, we may disclose health information relevant to a family member, close friend, or other person you identify as involved in your care or payment for care, unless you object.
Substance Use Disorder Records
If Canyon Therapy receives, creates, or maintains records related to substance use disorder (SUD) treatment from a Part 2 program (as defined under 42 CFR Part 2), those records receive additional federal protections. SUD records may not be used to investigate or prosecute you. Redisclosure of SUD records is restricted under federal law. If applicable, we will obtain your consent before using or disclosing SUD records for treatment, payment, or healthcare operations purposes.
Uses and Disclosures That Require Your Written Authorization
For uses and disclosures not described in this Notice, we will obtain your written authorization before using or disclosing your health information. These include:
Marketing purposes (except face-to-face communications and promotional gifts of nominal value)
Sale of your protected health information
Most uses and disclosures of psychotherapy notes (if applicable)
You may revoke any authorization you provide at any time by submitting a written request to our Privacy Contact. Your revocation will not affect any uses or disclosures that occurred before we received your written request.
Your Rights Regarding Your Health Information
You have the following rights with respect to your protected health information:
Right to Access and Inspect You have the right to access and obtain a copy of your health information maintained by Canyon Therapy, with limited exceptions. If your records are maintained electronically, you may request an electronic copy in a readily producible format. To request access, submit a written request to our Privacy Contact. We may charge a reasonable, cost-based fee for copying and mailing. We will respond to your request within 30 days.
Right to Request an Amendment If you believe that health information we maintain about you is incorrect or incomplete, you may request an amendment. Your request must be submitted in writing to our Privacy Contact and must include the reason for the requested change. We may deny your request in certain circumstances and will provide you with a written explanation if we do so.
Right to an Accounting of Disclosures You have the right to request a list of certain disclosures we have made of your health information. This does not include disclosures made for treatment, payment, or healthcare operations, or disclosures you authorized in writing. To request an accounting, submit a written request to our Privacy Contact. Your request may cover up to six years prior to the date of the request.
Right to Request Restrictions You have the right to request that we restrict how we use or disclose your health information for treatment, payment, or healthcare operations. You may also request restrictions on disclosures to family members or others involved in your care. We are not required to agree to your request, except in one situation: if you pay for a service out of pocket in full and request that we not disclose information about that service to your health plan for payment or healthcare operations purposes, we must honor that request. This restriction does not apply to disclosures required by law or to disclosures for your treatment by another healthcare provider when that provider needs the information to treat you.
Right to Request Confidential Communications You have the right to request that we communicate with you about your health information by alternative means or at an alternative location. For example, you may request that we contact you only by mail or at a specific phone number. We will accommodate reasonable requests.
Right to a Paper Copy of This Notice You have the right to receive a paper copy of this Notice at any time, even if you have previously received one or agreed to receive it electronically. To request a paper copy, contact our office.
Right to Be Notified of a Breach You have the right to be notified if a breach of your unsecured protected health information occurs.
Our Responsibilities
Canyon Therapy is required by law to:
Maintain the privacy of your protected health information
Provide you with this Notice of our legal duties and privacy practices
Follow the terms of this Notice as currently in effect
Notify you if a breach occurs that may have compromised the privacy or security of your information
Make reasonable efforts to limit the use and disclosure of your protected health information to the minimum necessary to accomplish the intended purpose
Where Wyoming state law provides greater privacy protection than federal HIPAA requirements — such as protections for certain mental health or substance abuse records — we will follow the more protective standard.
We reserve the right to change the terms of this Notice and to make the new provisions effective for all protected health information we maintain. If we revise this Notice, we will post the revised version in our office and on our website, and a copy will be available upon request.
Filing a Complaint
If you believe your privacy rights have been violated, you may file a complaint with Canyon Therapy or with the U.S. Department of Health and Human Services.
